This study aims to analyze the constitutional status of free basic education in private schools as affirmed by Constitutional Court Decision No. 3/PUU-XXII/2024 and to examine its initial implementation by the Government of the Special Capital Region of Jakarta Province. The research employs a normative juridical method, using a statutory approach and a case approach to assess constitutional norms, judicial reasoning, and policy implementation. Primary legal materials include the Constitutional Court decision and relevant legislation, supported by secondary and tertiary legal sources, which are analyzed qualitatively using descriptive-analytical techniques. The results demonstrate that the Constitutional Court explicitly recognizes free basic education as a constitutional and human right that must be fulfilled by the state without discrimination between public and private education providers. Through progressive constitutional interpretation, the Court establishes state financing of basic education as a binding constitutional obligation applicable to both central and regional governments. Furthermore, the pilot implementation of free basic education in 40 private schools in Jakarta reflects concrete compliance with the Courts final and binding ruling. In conclusion, the Jakarta policy initiative may serve as a strategic model for national implementation, contributing to equitable educational access and human resource development, provided it is accompanied by strengthened governance, accountability mechanisms, and complementary educational reforms.

Putusan Mahkamah Konstitusi Nomor 3/PUU-XXII/2024 telah memperkuat landasan konstitusional pendidikan dasar gratis di sekolah swasta.Implementasi awal kebijakan ini oleh Pemerintah Provinsi DKI Jakarta menunjukkan tingkat kepatuhan konstitusional yang progresif.Kebijakan ini berpotensi memperluas akses pendidikan dasar dan mengurangi ketimpangan sosial, namun memerlukan dukungan anggaran, regulasi daerah yang kuat, dan tata kelola yang akuntabel.

Berdasarkan hasil penelitian, terdapat beberapa saran penelitian lanjutan yang dapat dilakukan. Pertama, perlu dilakukan evaluasi empiris terhadap dampak kebijakan pendidikan dasar gratis di sekolah swasta terhadap capaian pembelajaran dan kualitas pendidikan. Kedua, penelitian komparatif antardaerah dapat dilakukan untuk mengidentifikasi model implementasi yang adaptif dan berkelanjutan dalam kerangka sistem pendidikan nasional. Ketiga, kajian mendalam mengenai mekanisme pendanaan yang komplementer dan berkelanjutan, termasuk potensi peran sektor swasta dan masyarakat, perlu dilakukan untuk menjamin keberlanjutan kebijakan pendidikan dasar gratis di sekolah swasta. Penelitian-penelitian ini diharapkan dapat memberikan kontribusi signifikan dalam pengembangan kebijakan pendidikan yang lebih inklusif, adil, dan berkualitas di Indonesia.
