Consumer protection in the digital age presents unique challenges and opportunities, particularly in the context of emerging platforms like TikTok Shop. This study undertakes a comparative analysis of the legal aspects of consumer protection in e-commerce transactions and TikTok shops in Indonesia. Through a normative approach, key similarities, differences, challenges, and opportunities are identified, shedding light on the evolving regulatory landscape and its implications for consumers, businesses, and policymakers. Findings highlight the need for adaptive regulation, enhanced enforcement mechanisms, industry collaboration, and consumer empowerment to ensure a fair, transparent, and accountable digital commerce ecosystem.

The analysis underscores the importance of adaptation, collaborative governance, and consumer empowerment in the digital commerce ecosystem.While traditional e-commerce transactions benefit from established regulatory frameworks, emerging platforms like TikTok Shop require innovative responses that accommodate new business models and consumer behaviors.Policymakers, regulatory authorities, industry stakeholders, and consumers must work together to address regulatory blind spots, enhance enforcement capacities, promote responsible business practices, and empower consumers with knowledge and tools to navigate the digital marketplace effectively.

Berdasarkan analisis terhadap latar belakang, metode, hasil, keterbatasan, dan saran penelitian lanjutan yang ada, beberapa saran penelitian lanjutan dapat diajukan. Pertama, penelitian lebih lanjut dapat dilakukan untuk mengeksplorasi efektivitas mekanisme penyelesaian sengketa konsumen di TikTok Shop, dengan fokus pada bagaimana platform dapat memfasilitasi mediasi dan arbitrase yang adil dan transparan. Kedua, penelitian kuantitatif dapat dilakukan untuk mengukur tingkat literasi digital konsumen Indonesia terkait transaksi online, khususnya di TikTok Shop, dan mengidentifikasi faktor-faktor yang memengaruhi kerentanan konsumen terhadap praktik penipuan. Ketiga, penelitian kualitatif dapat dilakukan untuk menganalisis persepsi dan pengalaman konsumen Indonesia terhadap perlindungan data pribadi mereka di TikTok Shop, serta mengidentifikasi rekomendasi untuk meningkatkan keamanan dan privasi data. Dengan menggabungkan ketiga saran ini, diharapkan dapat memberikan pemahaman yang lebih komprehensif tentang tantangan dan peluang dalam melindungi konsumen di era digital, serta mendorong pengembangan kebijakan dan praktik yang lebih efektif untuk menciptakan ekosistem perdagangan digital yang adil, aman, dan berkelanjutan.
