The advancement of digital technology and the transformation toward electronic-based governance have brought new challenges to the protection of citizens privacy rights, particularly concerning personal data. In the digital era, personal data has become increasingly vulnerable to misuse and data breaches, while Indonesias legal framework is still in the process of adapting to these issues. This study aims to analyze the extent to which the right to privacy and personal data is constitutionally protected, and how the state is obligated to ensure such protection. This research uses normative legal methods with a juridical- conceptual approach. The findings indicate that the right to privacy is constitutionally guaranteed in the 1945 Constitution of the Republic of Indonesia, particularly in Article 28G paragraph (1) and Article 28H paragraph (4), although personal data is not explicitly mentioned. The enactment of Law No. 27 of 2022 on Personal Data Protection marks a significant step in strengthening legal safeguards for digital privacy. It must be supported by the establishment of an independent supervisory authority, adaptive policy formulation, and increased digital literacy among the public.

The protection of privacy rights over personal data in Indonesia is a constitutional issue becoming increasingly important with rapid digitalization.The 1945 Constitution guarantees the right to privacy, and Law No.27 of 2022 on Personal Data Protection is a significant step towards a comprehensive legal framework.Effective implementation requires an independent supervisory agency, increased digital literacy, and harmonization with international standards to ensure citizens digital rights are protected in the era of digital government and economy.

Further research should investigate the effectiveness of the Personal Data Protection Authority (LPPDP) in enforcing data protection regulations and addressing data breaches. Additionally, studies are needed to assess the impact of digital literacy programs on public awareness and responsible data sharing practices. Finally, research should explore the challenges and opportunities of cross-border data flows in the context of Indonesias evolving data protection landscape, considering the need for international cooperation and harmonization of legal frameworks. These investigations are crucial to ensure that Indonesias legal system effectively safeguards citizens privacy rights in the face of ongoing technological advancements and the increasing interconnectedness of the digital world, requiring at least 150 words to fully address the complexities of these issues and provide actionable insights for policymakers and stakeholders.
