The enforcement of final and binding judicial decisions is essential to uphold legal certainty and the rule of law. However, in Indonesia, significant delays and non-execution of criminal convictions have exposed systemic deficiencies. This study presents a jurisprudential analysis of the Silfester Matutina conviction case where a 1.5-year prison sentence issued by the Supreme Court in 2019 remained unexecuted through August 2025 to examine the legal and institutional factors causing enforcement failure. Employing a normative juridical approach combined with case study methodology, the research integrates doctrinal analysis of statutes, judicial decisions, and prosecutorial regulations with theoretical frameworks from Legal Positivism, Sociological Jurisprudence, Legal Realism, and Natural Law. Quantitative indicators were applied to assess legal certainty, prosecutorial discretion, public trust impact, and constitutional compliance. Findings reveal a six-year enforcement gap, a 75% decline in legal certainty, and excessive prosecutorial discretion (95% vs. international benchmark of 35%), confirming the abuse of discretionary power and the erosion of institutional legitimacy. Comparative analysis with European best practices highlights the need for specialized enforcement bodies and mandatory execution timelines. The study concludes with policy recommendations for legislative reform, institutional restructuring, and enhanced oversight to restore public trust, ensure timely execution of judgments, and reinforce the deterrent effect of criminal sanctions. Limitations and avenues for future empirical research are also discussed.

The analysis reveals a profound disjuncture between legal theory and practice, exposing systemic vulnerabilities within Indonesias criminal justice enforcement framework.The failure to enforce a final criminal conviction undermines constitutional guarantees of legal certainty and the rule of law.The case demonstrates how prosecutorial discretion, intended to facilitate justice, can be misapplied to frustrate clear judicial mandates, eroding institutional legitimacy.Ultimately, comprehensive reform is needed, including legislative changes, specialized enforcement bodies, and enhanced oversight, to restore public trust and uphold the deterrent effect of criminal sanctions.

Berdasarkan temuan penelitian ini, beberapa saran penelitian lanjutan dapat diajukan. Pertama, penelitian empiris perlu dilakukan untuk mengukur dampak konkret dari penundaan eksekusi putusan pengadilan terhadap kepercayaan publik terhadap sistem peradilan pidana di Indonesia. Penelitian ini dapat menggunakan metode survei dan wawancara mendalam untuk mengumpulkan data dari berbagai lapisan masyarakat. Kedua, studi komparatif yang lebih luas perlu dilakukan untuk menganalisis efektivitas berbagai model penegakan hukum di negara-negara dengan sistem hukum yang serupa dengan Indonesia. Studi ini dapat membandingkan pendekatan Indonesia dengan negara-negara Eropa yang telah berhasil menerapkan badan penegak hukum khusus dan tenggat waktu eksekusi yang wajib. Ketiga, penelitian lebih lanjut diperlukan untuk mengeksplorasi peran teknologi dalam meningkatkan efisiensi dan transparansi proses penegakan hukum. Hal ini dapat mencakup pengembangan sistem informasi terintegrasi yang memungkinkan pemantauan real-time terhadap status eksekusi putusan pengadilan dan penggunaan kecerdasan buatan untuk mengidentifikasi potensi hambatan dalam proses tersebut. Penelitian-penelitian ini diharapkan dapat memberikan wawasan yang lebih mendalam tentang tantangan dan peluang dalam meningkatkan efektivitas penegakan hukum di Indonesia, serta memberikan dasar bagi perumusan kebijakan yang lebih tepat sasaran dan berkelanjutan.
