Indonesian Journal of Labour Law and Industrial RelationsIndonesian Journal of Labour Law and Industrial RelationsEvery job carries a risk of disability or death due to work accidents, which can occur both in traditional industries and in roles like package delivery. This journal examines the social security rights of package delivery couriers who experience fatal work accidents. The research employs a normative juridical approach with a statutory analysis. The lack of explicit criminal sanctions for employers who fail to register workers for social security results in unfulfilled rights for workers.
The study reveals that J&T couriers, as workers, are entitled to social security, including work accident and death insurance, as mandated by Indonesian law.Employers have a legal obligation to ensure this security, and failure to do so can result in administrative sanctions.However, the rights of freelance couriers differ, requiring independent registration for social security benefits.Strengthening regulations and increasing awareness are crucial to protect the rights of all couriers.
Further research should investigate the specific challenges faced by freelance couriers in accessing social security and explore alternative models for providing them with adequate protection. Additionally, a comparative study examining the legal frameworks for courier worker rights in other countries could offer valuable insights for improving Indonesian regulations. Finally, research is needed to assess the effectiveness of current administrative sanctions against non-compliant employers and to propose more robust deterrents, potentially including criminal penalties, to ensure full compliance with worker protection laws. These studies should aim to provide a comprehensive understanding of the issues and inform policy recommendations that prioritize the safety and well-being of all delivery couriers, fostering a more equitable and secure working environment for this growing segment of the workforce.
