This paper aims to scrutinise the Malaysian juvenile justice system and the negative consequences of the lack of pre-trial alternative measures in dealing with children. Juvenile delinquency is a social problem that has attracted numerous discussions from different quarters. One of the primary issues in this area is how to respond to complex, multifaceted problems involving children in conflict with the law. Through doctrinal analysis and comparative frameworks with international standards and legal practice in England and New Zealand, this study highlights the positive impact of diversionary approaches on recidivism, rehabilitation, and restorative justice. Malaysias heavy reliance on formal adjudication is inconsistent with several international standards. This paper advocates amending the Child Act 2001 and the Criminal Procedure Code to implement pre-trial diversion, with police and prosecutorial discretion to encourage restorative justice alternatives in minor and non-violent cases. This change would align Malaysias system with international norms, improve childrens rights, and advance the justice system toward greater rehabilitation and restoration.

The current Malaysian juvenile justice system heavily relies on formal adjudication, which is inconsistent with international standards.The paper advocates for amending the Child Act 2001 and the Criminal Procedure Code to implement pre-trial diversion, granting police and prosecutors discretion to utilize restorative justice alternatives for minor offenses.Adopting these changes would align Malaysias system with international norms, enhance childrens rights, and promote rehabilitation and restoration.

Further research should investigate the specific types of restorative justice programs most effective for different categories of juvenile offenders in the Malaysian context. Additionally, a study could explore the potential for culturally sensitive diversion programs that incorporate traditional Malaysian practices to address the root causes of juvenile delinquency. Finally, research is needed to assess the training needs of police officers and prosecutors to effectively implement pre-trial diversion and exercise appropriate discretion, ensuring a child-centered approach to juvenile justice. These investigations should consider the existing limitations of the current system, such as resource constraints and potential biases, and propose practical solutions to overcome these challenges. The goal is to develop a comprehensive and sustainable pre-trial diversion framework that prioritizes rehabilitation, restorative justice, and the best interests of the child, while also ensuring public safety and accountability.
