The potential of traditional knowledge of the indigenous people of Tenganan Pegringsingan, Bali, suggests that this potential can be measured through the concept of Intellectual Property Rights, in accordance with WIPO parameters and Government Regulation No. 56 of 2022. However, this potential has not been identified as an intellectual property right. This article explores the diverse traditional wisdom within the Tenganan community that potentially has an intellectual property right, recorded as knowledge within the Intellectual Property Rights regime using a proprietary system. Employing a qualitative method with hermeneutic analysis, the study explores the traditional wisdom of the Tenganan people and its potential for protecting intellectual property rights. The results aim to identify the traditional knowledge of the Tenganan community and classify it within the Indonesian Intellectual Property Rights Law, supporting the communal intellectual property of the Tenganan people.

Conclusion

The study concludes that biological natural resources are not solely utilized for basic sustenance by the Tenganan people.The research identifies four categories of traditional knowledge within the community.Protecting this traditional knowledge is crucial for safeguarding communal intellectual property rights in Indonesia.

Future Research

Further research should investigate the specific mechanisms for documenting and preserving the traditional knowledge of the Tenganan people, moving beyond identification to practical archiving and accessibility. A comparative study examining the effectiveness of different intellectual property protection models – such as geographical indications, collective rights, or sui generis systems – in safeguarding Tenganans traditional knowledge is needed to determine the most appropriate legal framework. Finally, research should explore the potential for benefit-sharing mechanisms that ensure the Tenganan community receives equitable compensation for the commercialization of their traditional knowledge, fostering sustainable development and cultural preservation. These investigations should be conducted in close collaboration with the Tenganan community, respecting their cultural protocols and ensuring their active participation in the research process, to create a robust and culturally sensitive framework for protecting their intellectual heritage and promoting its responsible use.
