Dari temuan putusan tersebut, penelusuran dan perbincangan pencipta beranggapan bahwa pendisiplinan terhadap pelaku pelanggaran narkotika sudah melewati dakwaan pemeriksa umum (konsentrasi nomor 415/Pid.Sus/2020/PN Prp), yakni mengingat Dalam persidangan pendahuluan, tergugat tidak terbukti melakukan perbuatan melawan hukum yang didakwakan oleh pemeriksa terbuka baik dalam dakwaan Pasal 114 ayat (1) UU Opiat maupun Pasal 112 ayat (1) UU Opiat.Meski demikian, hakim mengabulkan pilihan pidana dengan memperhatikan Pasal 127 huruf a Peraturan Opiat, dimana Pasal 127 huruf a tidak didakwakan oleh pemeriksa umum.Oleh karena itu, penulis tidak sependapat dengan pilihan hakim tersebut dengan alasan, secara yuridis, pilihan yang diberikan oleh penguasa yang ditunjuk merugikan kepastian hukum karena menyimpang dari Pasal 182 ayat (4) KUHP dan beberapa undang-undang lainnya.Penulis mengusulkan agar setiap putusan pidana yang diambil oleh hakim harus didasarkan pada bukti-bukti yang tercantum dalam surat dakwaan penuntut umum.

Berdasarkan penelitian ini, ada beberapa saran penelitian lanjutan yang dapat dilakukan. Pertama, perlu dilakukan penelitian lebih mendalam tentang peran hakim dalam memutus perkara pidana, khususnya terkait dengan bukti-bukti yang digunakan dalam persidangan. Kedua, penelitian tentang penerapan hukum acara pidana dalam kasus-kasus narkotika dapat dilakukan untuk memastikan bahwa proses hukum berjalan dengan adil dan sesuai dengan peraturan yang berlaku. Ketiga, penelitian tentang dampak putusan hakim terhadap pelaku tindak pidana narkotika dan masyarakat dapat dilakukan untuk memahami implikasi sosial dan hukum dari putusan tersebut.
