The need for mediation is motivated by the accumulation of cases at the cassation level. Every year the number of cases entering the Court does not decrease, but increases. Meanwhile, the judge who has to resolve the case has limited capacity, so the cases that come in cannot be resolved quickly. This happened at the Religious Court in the Banjarmasin PTA area. Therefore, the concept of mediation is needed to reduce the problem of the accumulation of cases that occur at the religious court level, in terms of the benefit of childrens growth and development. The research approach chosen uses an empirical juridical approach with a descriptive research method of analysis of theories of mediation and child protection and their implementation in judges decisions regarding divorce in the Religious Courts in the Banjarmasin PTA area. Divorce has a negative impact on childrens psychological development, because in general the psychological development of children whose parents are divorced is very disturbed, apart from that, the negative factor resulting from divorce is the lack of love and attention from both parents. Psychologically, parental divorce results in changes in behavior, responsibility and emotional stability.

Conclusion

Divorce can have negative and positive implications for childrens psychological development, but the negative implications are more dominant.Psychologically, the negative implications of parental divorce result in changes in behavior, responsibility and emotional stability.Lack of attention and affection for children towards the divorce of their parents causes feelings of anxiety, lack of confidence, depression, decline in academic achievement, confusion, shame and sadness.Efforts to increase the success of mediation still face challenges, namely the limited number of judges, the lack of involvement of non-judge mediators, and the program to accelerate case resolution.

Future Research

Berdasarkan hasil penelitian ini, beberapa saran penelitian lanjutan dapat diajukan. Pertama, penelitian lebih lanjut perlu dilakukan untuk mengeksplorasi efektivitas berbagai model pelatihan mediator, khususnya bagi hakim, dalam meningkatkan keterampilan mereka dalam menangani kasus perceraian yang melibatkan kepentingan terbaik anak. Kedua, penelitian kualitatif mendalam dapat dilakukan untuk memahami perspektif anak-anak tentang pengalaman mereka dalam proses mediasi perceraian orang tua mereka, termasuk bagaimana mereka merasakan keterlibatan mereka dalam proses tersebut dan apa yang dapat dilakukan untuk meningkatkan pengalaman mereka. Ketiga, penelitian komparatif dapat dilakukan untuk membandingkan efektivitas mediasi dalam kasus perceraian di berbagai yurisdiksi, dengan mempertimbangkan perbedaan budaya, hukum, dan sistem peradilan. Penelitian ini dapat memberikan wawasan berharga tentang praktik terbaik dalam mediasi perceraian dan membantu meningkatkan kualitas layanan mediasi yang tersedia bagi keluarga yang menghadapi perceraian. Selain itu, penelitian perlu dilakukan untuk mengidentifikasi faktor-faktor yang berkontribusi terhadap rendahnya tingkat keberhasilan mediasi dalam kasus perceraian di Pengadilan Agama wilayah PTA Banjarmasin, seperti kurangnya sumber daya, kurangnya kesadaran masyarakat tentang manfaat mediasi, atau hambatan budaya tertentu. Dengan memahami faktor-faktor ini, langkah-langkah dapat diambil untuk meningkatkan efektivitas mediasi dan memastikan bahwa lebih banyak keluarga dapat menyelesaikan perselisihan mereka secara damai dan konstruktif.
